OVERVIEW
Welcome to SNUGLER. These Terms of Service (“Terms”) govern your use of snugler.com and any purchase you make through our online store (collectively, the “Services”). The terms “SNUGLER,” “we,” “us,” and “our” refer to SNUGLER. Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

By accessing or using the Services, or by placing an order, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Shipping Policy, and Refund & Return Policy. If you do not agree, do not use the Services. Nothing in these Terms limits any rights or remedies that cannot be waived under applicable consumer protection law.

1. ELIGIBILITY AND ACCOUNT INFORMATION
You must be at least the age of majority in your state or province of residence to make a purchase. You agree to provide current, complete, and accurate information when using the Services, including billing, payment, contact, and shipping information. You are responsible for maintaining the confidentiality of any account credentials and for activity under your account.

2. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to describe and display our Plush Bamboo-Viscose Mattress Topper accurately. Product colours, textures, dimensions, and appearance may vary slightly because of screen settings, photography, manufacturing tolerances, and the natural characteristics of materials. Your topper may arrive vacuum-packed and may require time after opening to expand and regain its shape.

We may update product information, correct errors, or discontinue products when appropriate. If a product you ordered was materially misdescribed, your remedies are governed by our Refund & Return Policy and applicable law.

3. PRICES AND PAYMENT
Current listed prices are $89.99 USD for Queen and $109.99 USD for King. The price charged will be the price displayed at checkout when you submit your order. Prices, promotions, and product availability may change prospectively without notice. Applicable taxes and any other charges will be shown before you complete your purchase.

You authorize SNUGLER and its payment processors to charge the payment method you provide for the total shown at checkout. You represent that you are authorized to use that payment method and that the information you provide is accurate. If we correct a material pricing error or cannot accept an order after payment has been collected, we will provide the refund required by applicable law.

4. ORDERS AND ORDER ACCEPTANCE
Submitting an order is an offer to purchase. An automated order acknowledgement confirms that we received your order; it does not necessarily mean that we have accepted it. We may accept, decline, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment authorization issues, pricing or listing errors, or shipping restrictions, subject to applicable law.

If we decline or cancel an order after payment has been collected, we will refund the amount due to the original payment method. Products are intended for personal or household use and may not be purchased for unauthorized resale or export.

5. PRODUCT AVAILABILITY
All products are subject to availability. We may limit quantities, restrict sales by geographic region, or discontinue a product. If an item becomes unavailable after you order, we will contact you and provide an appropriate resolution, which may include cancellation and a refund.

6. SHIPPING AND DELIVERY
We ship exclusively within the contiguous United States. Standard shipping is free on every eligible order, with no minimum purchase. We do not currently ship to Alaska, Hawaii, Puerto Rico or other U.S. territories, international destinations including Canada, P.O. boxes, or APO/FPO/DPO addresses.

Orders are usually processed within 1–3 business days after payment confirmation. Most orders arrive within approximately 7–12 calendar days of purchase, including processing and shipping. These timeframes are estimates rather than guarantees and may vary because of location, carrier operations, weather, holidays, busy periods, or events outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. Contact support@snugler.com promptly if you notice an error. We will try to update the address before shipment but cannot guarantee a change after dispatch. Please see our Shipping Policy for complete details, including tracking, delayed or lost orders, and damaged deliveries.

7. RETURNS, REFUNDS, REPLACEMENTS, AND CANCELLATIONS
Our Refund & Return Policy forms part of these Terms. If your topper arrives damaged, defective, materially different from its description, or is not what you ordered, contact support@snugler.com within 7 days of delivery with your order number, a brief description, and clear photos when possible. This reporting period helps us investigate promptly and does not limit any rights you have under applicable law.

Because bedding is a personal product, we do not accept voluntary returns or issue refunds based only on comfort preference or a change of mind, including a desire for a softer or firmer feel, general dissatisfaction when the product is not defective or misdescribed, accidental purchases, or products no longer wanted after purchase.

Eligible requests are reviewed based on their circumstances and the outcome of our review. They may be resolved through a replacement, refund, or another appropriate remedy. Do not return a product unless we approve the return and provide instructions. When a return is required for an approved damaged, defective, or incorrect item, we will provide instructions and cover return shipping.

To request cancellation, email support@snugler.com as soon as possible. We will try to help before the order ships. Once an order is in transit, cancellation may no longer be possible, and any later request will be reviewed under the Refund & Return Policy and applicable law.

8. CUSTOMER RESPONSIBILITIES
You agree to use the Services lawfully and to provide accurate information. You may not misuse the Services; interfere with their operation or security; introduce malware; attempt unauthorized access; scrape or collect data without permission; impersonate another person; submit fraudulent orders; infringe intellectual property or privacy rights; or use the Services in a way that harms SNUGLER, Shopify, our service providers, or other users.

9. WEBSITE USE AND THIRD-PARTY SERVICES
We may update, suspend, or discontinue parts of the Services when reasonably necessary. The Services may include links to third-party websites or tools. We do not control those third parties and are not responsible for their content, availability, or practices. Your use of third-party services is governed by their terms and policies.

Shopify provides the ecommerce platform supporting our store, but purchases from our store are transactions directly between you and SNUGLER.

10. INTELLECTUAL PROPERTY
The Services and their content, including our name, branding, text, graphics, images, product descriptions, and site design, are owned by or licensed to SNUGLER and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, publish, sell, exploit, or create derivative works from protected content without prior written permission, except as permitted by law.

11. REVIEWS AND FEEDBACK
If you submit a review, suggestion, image, or other feedback, you confirm that you have the right to provide it, that it is accurate, and that it does not violate another person’s rights or applicable law. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that feedback for operating and promoting the Services. This licence does not override rights that cannot be waived under applicable law.

12. ERRORS AND CORRECTIONS
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product information, pricing, promotions, availability, shipping charges, or delivery estimates. We may correct these issues and update information. If a correction materially affects an order you already placed, we will act in accordance with applicable law and contact you when required.

13. PRIVACY
Our Privacy Policy explains how personal information is collected, used, disclosed, and protected when you use the Services. Because Shopify hosts the store, Shopify also processes information as described in Shopify’s applicable privacy notices. Please review our Privacy Policy before using the Services.

14. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not promise that the Services will always be uninterrupted, error-free, or completely secure. Any warranties, representations, conditions, or guarantees that cannot lawfully be excluded remain in effect. Product-specific rights and remedies are governed by our published policies and applicable law.

15. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, SNUGLER and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services or purchase of a product. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing in this section limits any non-waivable consumer rights or remedies.

16. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold SNUGLER harmless from third-party claims, losses, or reasonable costs resulting from your unlawful use of the Services, your material breach of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from SNUGLER’s own conduct or where prohibited by law.

17. TERMINATION
We may suspend or terminate access to the Services if you materially breach these Terms or misuse the Services. Provisions that by their nature should survive termination, including intellectual property, liability, governing law, and accrued payment obligations, will continue to apply.

18. GOVERNING LAW
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. The courts of Ontario will have jurisdiction, except where applicable law gives you the right to bring a claim in another forum. Nothing in this section deprives you of mandatory consumer protections that apply in your state, province, or country of residence.

19. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Services, our practices, or legal requirements. The current version will be posted on this page with an updated date. Material changes will apply prospectively and will be communicated when required by law. Changes do not reduce rights or remedies relating to an order placed before the change where prohibited by law.

20. GENERAL TERMS
If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with the policies referenced here and any order-specific terms shown at checkout, form the agreement between you and SNUGLER regarding the Services.
